GAmerz on Wheelz Policies

DEPOSIT/REFUND/CANCELLATION POLICY:
A valid credit card or debit card is required to reserve your reservation. Payment in full will be required to hold your reservation once we confirm your booking date and time. There will be a $25 cancellation fee for all parties or events canceled after payment is received. NO REFUND in the event of reservation being canceled within 14 days of your event. We will make every effort to postpone your event, with no penalty, to another date should cancellation be necessary.

PRIVACY POLICY:
Gamerz on Wheelz is committed to protecting your privacy. We use the information we collect on the site to make bookings as simple as possible and to enhance your overall experience. We do not sell, trade, or rent your personal information to others.

TRAVEL SURCHARGE:
Our general service area covers the state of Mississippi. There is a possible fuel surcharge fee depending on the location of the event.  We can discuss those charges at the time of booking the event.

 

BAD WEATHER:
The Gamerz on Wheelz mobile game trailer is designed for all types of weather conditions. The trailer is climate controlled with heat and air conditioning. There may be occasions when the weather does not want to cooperate with your scheduled party. In the event of severe weather (lightning, very high winds, flooding and/or extremely heavy rains, etc.) we may (and reserve the right to) reschedule your service to guarantee the safety of you, your guests, our staff and equipment. If the threat of these storms threatens your party and you are aware in advance (pending or anticipated major storm or other strong weather event) please contact us to begin the rescheduling.

SUPERVISED CHILDREN:
Gamerz on Wheelz does require a parent or responsible adult to be always present inside or just outside of the trailer. Guests under the age of 16 require a parent or guardian be on property and within contact of the game coach should a need to contact them arise.

ALCOHOL/DRUGS:
You may serve alcohol at your event or party; however, we reserve the right to refuse, cancel or cut short any party or booking when alcohol is being served. Drugs of any sort will not be tolerated in or around the equipment. Any observed use of illegal narcotics or legal narcotics used in an illegal manner will result in the termination of the party immediately.

DAMAGE/INJURY:
Neither Gamerz on Wheelz nor any of its employees shall be responsible for any damage to property resulting from a request by the client to position the trailer in a specific location. This includes both above ground and below ground property/equipment damage. Additionally, we reserve the right to charge the client’s credit card for damages to the trailer or equipment resulting from the careless or willful damage of same by clients’ guests. Neither Gamerz on Wheelz nor its employees assume any responsibility for any injuries sustained on the client’s property or their designated location. All liability for damages or injuries are the sole responsibility of the client and/or host.

FOOD/DRINK:
Gamerz on Wheelz does not allow any food or drinks into the video game trailer. Please have your guests consume them outside of the trailer prior to entering.

PICTURES:
While your party is in effect the Game Coach may be taking pictures of the party from inside the trailer. We may use these on our Facebook page or our web site. If you do not want our Game Coach taking these pictures or posting them on Facebook or our web site, please notify the Game Coach prior to the start of the party. 

TIPS:
The Game Coach is there to make sure that your group is making the most of our high-tech fun. He tutors, inspires and entertains. Tipping for good service is a great idea, but not required.

OUR TRUCK/TRAILER:
When the truck pulls up, we will try to park in the most level & flat area or logical spot to accommodate your party. Sometimes, we park in your neighborhood street, so you might want to let your neighbors know (in case they may object) or let us know if you have a preferred spot for us. We might also have to block a driveway. **Please keep in mind that our Game Coach will not park anywhere that may cause a danger to persons, property or equipment. Our truck and trailer combination is long and we will need a minimum of 55 feet of space to maneuver and park. Additionally, our Game Coach will never disconnect the truck from the trailer at a party/event without prior approval nor park off a hardened surface.

VIDEO GAME RATINGS:
Our Game Coach will not play any “M” rated or higher game in the video game theater without authorization from the client prior to the party/event or adult approval at the time of the event. If you wish to have an “M” rated game or higher at your party/event please contact us, indicating the game you prefer or let the Game Coach know as soon as you can after he gets there.

RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PUBLICITY RELEASE

 

​READ CAREFULLY—THIS AFFECTS YOUR LEGAL RIGHTS
I agree to the following:
1. I recognize that there are certain significant risks associated with the interactive entertainment activities organized by Gamerz on Wheelz. These risks include, but are not limited to, serious bodily injuries and/or psychological harm caused by involvement in a stressful environment that may require some physical exertion. I understand that Mature and Teen rated titles may be played during the experience and that my child/children may be exposed to this content. I am fully responsible for making all parties (essentially including, but not limited to the host parent and Gamerz on Wheelz personnel) aware of any special needs or allergies my child/children may have. The risk of serious injury from participating in Gamerz on Wheelz activities, although minimal, does exist as it does in all play and amusement activities. I agree to assume full responsibility for any personal injury I may sustain in connection with participation in interactive entertainment activities organized by Gamerz on Wheelz, and I release and discharge Gamerz on Wheelz and its owners, employees, representatives, and agents from any liability for any injuries I may sustain, including injuries caused by the negligence of Gamerz on Wheelz or its employees, representatives, or agents.
2. I agree to indemnify and defend Gamerz on Wheelz and its owner, employees, representative, and agents against all claims, causes of action, damages, judgments, cost, or expenses, including attorney fees and other litigation costs and expenses, which may in any way arise out of my participation in interactive entertainment activities organized by Gamerz on Wheelz, including injuries caused by the negligence of Gamerz on Wheelz or its employees, representatives, or agents.
3. I agree to pay for all damages to the facilities of Gamerz on Wheelz caused by my negligent, reckless, or willful conduct.
4. Any legal or equitable claim that may arise from my participation in interactive entertainment activities organized by Gamerz on Wheelz shall be resolved under Mississippi law with exclusive jurisdiction and venue being in the state and federal courts of the State of Mississippi.
5. I agree and acknowledge that I am under no pressure or duress to sign this Release and that I have been given a reasonable opportunity to review it before signing.
6. The invalidity or unenforceability of any provision of this Release, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Release or of any other application of such provision.
7. Any controversy or claim arising out of or relating to this Release, or the breach thereof, shall be settled by arbitration administered by a single arbitration appointed by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in the state or federal courts of the State of Mississippi or a court that has jurisdiction to enter it.
8. I hereby consent to the recording of statements, photographs, and/or audio or video recordings taken of my child/children/myself at this Gamerz on Wheelz event for advertising, trade and/or publicity purposes, without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet, without notice, review or approval by Gamerz on Wheelz personnel. All statements, photographs, and/or audio or video recordings taken of “the Minor(s)” or me, by Gamerz on Wheelz may be used by Gamerz on Wheelz for promotional, commercial or other purposes as determined by Gamerz on Wheelz anywhere in the world in its sole discretion. Neither “the Minor(s)” nor I shall have any right to control the use or publication by Gamerz on Wheelz of the statements, photographs, and/or audio or video recordings. On behalf of “the Minor(s)” and myself, all statements, photographs, and/or audio/video recordings taken of “the Minor(s)” or me by Gamerz on Wheelz or its contractors, shall be the sole property of Gamerz on Wheelz. Neither the Minor nor I shall receive any compensation in connection with use of these statements, photographs, and/or audio or video recordings for promotional, commercial or other purposes. I hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the statements, photographs, and/or audio or video recordings against Gamerz on Wheelz or any person or firm authorized by Gamerz on Wheelz to publish said materials (“Publisher”). Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of Gamerz on Wheelz and any Publisher. I further agree that Gamerz on Wheelz owns all images and recordings it takes of me, and I waive all interest in the images and recordings. The permissions granted hereby shall continue to be in force and effect forever.
 

 

 

ESRB Awareness and Parental Consent ​*Required for all participants under the age of 17 ESRB RATINGS GUIDE

The Entertainment Software Rating Board (ESRB) ratings provide concise and objective information about the content in video games and apps so consumers, especially parents, can make informed choices. ESRB ratings have three parts:
● Rating Categories​ suggest age appropriateness
● Content Descriptors​ indicate content that may have triggered a particular rating and/or
may be of interest or concern
● Interactive Elements​ highlight interactive or online features of a product, including users’
ability to interact with each other, the sharing of users’ location with other users, if purchases of digital goods or services are offered, and/or if unrestricted internet access is provided.
 

RATING CATEGORIES
EVERYONE
Content is generally suitable for all ages. May contain minimal cartoon, fantasy or mild violence and/or infrequent use of mild language.
EVERYONE 10+
Content is generally suitable for ages 10 and up. May contain more cartoon, fantasy or mild violence, mild language and/or minimal suggestive themes.

TEEN
Content is generally suitable for ages 13 and up. May contain violence, suggestive themes, crude humor, minimal blood, simulated gambling and/or infrequent use of strong language.
MATURE
Content is generally suitable for ages 17 and up. May contain intense violence, blood and gore, sexual content and/or strong language.
ADULTS ONLY
Content suitable only for adults ages 18 and up. May include prolonged scenes of intense violence, graphic sexual content and/or gambling with real currency.

RATING PENDING
Not yet assigned a final ESRB rating. Appears only in advertising, marketing and promotional materials related to a physical (e.g., boxed) video game that is expected to carry an ESRB rating, and should be replaced by a game’s rating once it has been assigned.
​”Online Music Not Rated by the ESRB”​ – Warns that songs that are streamed or downloaded as add-ons for music-based games have not been rated and that their content has not been considered in the ESRB rating assignment.
 

Note About Game Rating Selections Above I​f permission is not granted to play games rated “T” for Teen and/or games rated “M” for Mature, we will restrict gaming party exposure to only titles rated “E” for everyone or “10+”. This will limit the console choices offered primarily to Switch, PS5, and a small amount of select titles available for XBOX.

I acknowledge that I have read and fully understand the foregoing release of liability. I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I UNDERSTAND THAT BY SIGNING BELOW, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
